Welcome to Gus. These Terms of Service (“Terms”) are a legal agreement between you and Azgard Pty Ltd (ABN 96 642 676 579) (“we”, “us”, “our”, “Azgard”) and govern your access to and use of Gus, our lawn care quoting platform. By accessing or using Gus, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using our service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use Gus.

2. Description of Service

Gus is a software platform designed to help lawn care professionals create accurate quotes and manage their business operations. Our service includes:

  • Quoting tools with cost calculations and profit visibility
  • Property mapping using satellite imagery to measure lawn areas
  • Customer relationship management features
  • Business cost tracking and reporting

3. Account Registration

To use Gus, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorised access to your account

4. Subscription and Billing

Gus operates on a subscription basis. By subscribing to our service, you agree to the following:

  • Pricing: Subscription fees are as displayed on our website at the time of purchase.
  • Trial Period: We may offer a free trial period. At the end of the trial, your subscription will automatically convert to a paid subscription unless cancelled.
  • Billing Cycle: Subscriptions are billed monthly or annually, depending on your chosen plan.
  • Cancellation: You may cancel your subscription at any time. Access will continue until the end of your current billing period.
  • Refunds: Subscription fees are generally non-refundable, except where required by law.

5. User Obligations

When using Gus, you agree to:

  • Use the service only for lawful purposes
  • Provide accurate property measurements and business data
  • Not use the service to send spam, harass others, or engage in fraudulent activity
  • Not attempt to gain unauthorised access to our systems or other users' accounts
  • Not reverse engineer, decompile, or attempt to extract the source code of our software
  • Comply with all applicable laws and regulations

6. Intellectual Property

Our Content: The Gus platform, including its design, features, code, and content, is owned by Azgard Pty Ltd and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express permission.

Your Content: You retain ownership of any data, quotes, customer information, and other content you create or upload to Gus. By using our service, you grant us a limited licence to use this content solely to provide and improve our service.

7. Disclaimer of Warranties

Gus provides estimates and calculations based on the data you input. We make no guarantees regarding:

  • The accuracy of satellite imagery or property measurements
  • The suitability of cost calculations for your specific market
  • The success of quotes created using our platform in winning business

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AZGARD PTY LTD AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF GUS.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Termination

We may suspend or terminate your access to Gus at any time, with or without cause, including for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Non-payment of subscription fees
  • Extended periods of inactivity

Upon termination, your right to use the service will immediately cease. You may export your data prior to termination.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of Gus shall be subject to the exclusive jurisdiction of the courts of Australia.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by posting a notice on our website or sending you an email. Your continued use of Gus after such changes constitutes acceptance of the updated Terms.
